    These General Terms and Conditions (hereinafter referred to as \u201cGTC\u201d) apply to all contracts between<\/span><\/p>

    and the customer, who is an entrepreneur within the meaning of Section 14 BGB or a consumer within the meaning of Section 13 BGB, on the use of the products and services offered by the provider (e.g.<\/span>e.g. GPS vehicle tracking, fleet management software, SIM data services, etc.), which are offered via the website [<\/span>https:\/\/seyirmobil.de<\/span>] or by individual agreement.<\/span><\/span><\/p>

    1. Conclusion of contract<\/b><\/li><\/ol>

      The presentation of products and services on the website does not constitute a legally binding offer, but rather a non-binding invitation to the customer to submit an offer. By placing an order via the contact form, email, or telephone, the customer submits a binding contractual offer. The contract is only concluded upon express confirmation by the provider or upon provision of the service. <\/span><\/p>

      1. Scope of services<\/b><\/li><\/ol>

        The exact scope of services is specified in the respective service description on the website or in a written offer. The provider is entitled to adapt, improve or restrict the functions of its services for technical reasons, provided this is reasonable for the customer. <\/span><\/p>

        1. Prices and payment terms<\/b><\/li><\/ol>

          All prices are exclusive of statutory value added tax. Prices are valid in accordance with individual offer agreements. Payments are due immediately upon receipt of invoice without deduction, unless a different payment term has been agreed. In the event of late payment, the provider is entitled to charge interest on arrears at the statutory rate and to suspend performance until payment has been made in full. <\/span><\/p>

          1. Contract term and termination<\/b><\/li><\/ol>

            Unless otherwise agreed, the minimum contract term is 12 months. The contract is automatically extended by 12 months if it is not terminated with 4 weeks’ notice before the end of the respective term. The right to extraordinary termination for good cause remains unaffected. <\/span><\/p>

            1. Customer’s obligations to cooperate<\/b><\/li><\/ol>

              The customer undertakes:<\/span><\/p>

              • to provide truthful information during registration or when placing an order,<\/span><\/li>
              • to treat access data as confidential,<\/span><\/li>
              • not to distribute any illegal content via the platform,<\/span><\/li>
              • the technical requirements for the operation of the systems (e.g.<\/span>(e.g. Internet connection, power supply).<\/span><\/span><\/li><\/ul>
                1. rights of use<\/b><\/li><\/ol>

                  Insofar as software or a web application is provided to the customer for use, the customer shall receive a non-exclusive, non-transferable right of use for the duration of the contractual relationship. Any transfer, processing, reproduction, or publication is prohibited unless expressly permitted. <\/span><\/p>

                  1. Warranty and liability<\/b><\/li><\/ol>

                    The provider does not guarantee that the services will be available at all times without interruption. In the event of justified complaints, the customer is entitled to subsequent performance. Further claims are excluded, unless they are based on intent or gross negligence. <\/span><\/p>

                    The liability of the provider is limited to intent and gross negligence, regardless of the legal basis. In the event of simple negligence, the provider shall only be liable for breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract. <\/span><\/p>

                    1. Data protection<\/b><\/li><\/ol>

                      The provider processes the customer’s personal data exclusively within the framework of the applicable data protection laws. A detailed privacy policy is available at [https:\/\/seyirmobil.webtasarim.life\/datenschutz]. <\/span><\/p>

                      1. Final provisions<\/b><\/li><\/ol>

                        Should individual provisions of these General Terms and Conditions be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
